General terms and conditions

  1. Contracting

All our services are provided on the basis of our general terms and conditions (“AGB” for short) in the currently valid version. The terms and conditions can be viewed and downloaded on the Internet at www.taxi31300.at. Differing agreements or ancillary agreements require our written confirmation in order to be valid and are only valid for the respective individual business case. Any other general terms and conditions of our customers or contract partners are hereby rejected.

We arrange transport services for commercial passenger transport by passenger cars, which are kept available for everyone's use in public places or are requested by means of communication services (passenger transport industry by car — taxi) in accordance with the Occasional Transport Act as amended by “Transport Service”), in each case by means of communication services (collectively referred to as “Brokerage Service”) under the telephone number “31300” for Vienna. We act exclusively as an agent of transport services for taxi companies arranged by us, which provide transport services in the federal state of Vienna under the telephone number “31300” and in this sense we strive to arrange a transport service. These transport services are provided by independent taxi companies operating under the brand “31300” registered by us. The contract for the transport service is not concluded with us, but directly with the respective taxi company.

The customer can request a transport service arranged by us by telephone via the Vienna telephone number (01) 31300, by e-mail, fax, APP or via our website at www.taxi31300.at. The order for a transport service is only considered accepted when we expressly confirm the order for a transport service to the customer. We reserve the right to refuse to arrange transportation services without giving reasons.

  1. Remuneration and payment

Our agency services are provided free of charge to the person who uses or books the transport service.

For transport services, the tariffs applicable on the day of the transport service are generally charged for the tariff area of the Federal State of Vienna. For trips that are ordered via a communication service, the agreed fare may fall below or exceed the binding tariff that would apply for the same trip in accordance with the Vienna taxi tariff as amended (comparison trip) by a maximum of 20% (price range). The transport service is billed directly to the respective taxi company providing the transport. According to the Vienna Taxi, Rental Car and Guest Car Operating Regulations as amended, the passenger has the right to receive a proper invoice from the passenger, which must include in particular the route, the fare, the date, the taxi license plate, the taxi operator's stamp and the signature of the taxi driver.

  1. Cashless taxi driving

Transportation services can also be paid cashless as follows: a) For entrepreneurs using taxi vouchers, taxi prepaid cards issued by us, secret words after conclusion of a collection agreement or customer cards; b) For consumers using taxi vouchers and taxi prepaid cards issued by us. These vouchers, cards and secret words can be ordered from us by telephone, by order card or via our website at www.taxi31300.at. An order is only considered accepted when we expressly confirm it to the customer and, if necessary, a corresponding agreement has been signed with the customer. We reserve the right to reject an order without giving reasons.

3.1 Taxi value card

The taxi prepaid card is a cashless means of payment which is “charged” with a specific value through prior payment by the customer and can then be used to (repeatedly) pay for transport services until the loaded value is used up. The taxi prepaid card is not personalized and entitles the respective holder to use transportation services in compliance with the provisions of these terms and conditions, as long as the current value allows this.

3.2 Customer card

The customer card is issued in the name of the customer and entitles the customer to use transportation services in compliance with the provisions of these terms and conditions. If transport services are paid by customer card, we will charge them retrospectively, usually within 14 days, at the latest within 3 months.

3.3 Vouchers

Vouchers are issued in a certain amount and are charged by us in advance. The voucher is not personalized and entitles the respective holder to use cashless transportation services from Taxi 31300 in compliance with the provisions of these terms and conditions, as long as the current value of the voucher allows this.

Vouchers may be limited in time, at our discretion. If there is a time limit, the period of validity is printed on the voucher. During the time limit, the voucher can be used by the respective owner. At the end of the time limit, the respective owner can claim back the credit in writing. If the respective owner does not make use of this option within three months from the end of the time limit, the claim expires.

  1. Blocking the taxi prepaid card, customer card and/or secret word

If the customer discovers abusive dispositions with his taxi prepaid card, customer card and/or secret word or loses the taxi prepaid card, customer card and/or secret word, he must immediately contact Taxi31300 and have this card/secret word blocked. The same applies if the taxi prepaid card, customer card and/or secret word is stolen or otherwise lost. A taxi prepaid card, customer card and/or secret word can be blocked free of charge during customer center opening hours in writing via emailkundenzentrum@taxi31300.at or by fax 01/476 76-94 and by calling 01/476 76-250 (a written suspension must be sent immediately after the telephone suspension). The suspension is only considered to have taken place upon express confirmation of the suspension by Taxi 31300 to the customer.

In addition, Taxi 31300 has the right to block the taxi prepaid card, customer card and secret word if objective reasons in connection with the security of these cards or secret word justify this or if there is reasonable suspicion of unauthorised and/or fraudulent use of the cards or secret word or if, despite a reminder and a grace period, the customer does not have any outstanding claims against Taxi31300 in connection with the agreements relating to these cards or this secret word Accomplishes . As a result of this block, the option of paying for transport services by means of a taxi value card/customer card/secret word will also be discontinued with immediate effect.

  1. Consumer's right of withdrawal when ordering taxi prepaid cards, customer cards or vouchers and their legal consequences

If the customer is a consumer in accordance with Section 1 Consumer Protection Act (KSchG), the following legal right of withdrawal applies in the event of a contract concluded at a distance (i.e. by telephone, fax, order card or via our website) for vouchers or taxi prepaid cards:

The consumer can withdraw from a concluded contract within 14 days without giving reasons. The period for withdrawal begins on the day on which the consumer or a third party named by the consumer who is not acting as a carrier has acquired possession of the voucher and/or the taxi prepaid card (hereinafter referred to as “goods” in this section).

In order to exercise the right of withdrawal, the consumer must inform Taxi31300 (Taxi 31300 VermittlungsGmbH, 1150 Vienna, Johnstraße 4/7, email: kundenzentrum@taxi31300.at, fax: +43 1 476 76-94; tel: +43 1 476 76-250) of the decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, a fax or e-mail). The consumer can use the attached sample withdrawal form (withdrawal form) for this purpose. In order to meet the withdrawal period, it is sufficient for the consumer to send the notification of the exercise of the right of withdrawal before the withdrawal period has expired.

5.1 Exceptions to the right of withdrawal

A right of withdrawal under this point does not exist if the requirements of Section 18 FAGG are met, in particular within the meaning of Section 18 Paragraph 1 Z 1 FAGG, not in the case of services (such as transport services), if the (taxi) entrepreneur — on the basis of an express request from the consumer and confirmation by the consumer of his knowledge of the loss of the right of withdrawal when the contract has been fulfilled in full — with the performance of the service (transportation) service) and/or this service had then begun was provided in full.

5.2 Consequences of withdrawal

In the event of withdrawal, the consumer must return the goods to Taxi31300 immediately, but no later than 14 days from submission of the declaration of withdrawal. The return period is met if the goods are shipped within the period. The direct costs of returning the goods are borne by the consumer. The consumer must also pay Taxi31300 compensation for a reduction in the market value of the goods if this loss in value is due to handling of the goods that is not necessary to check the nature, properties and functioning of the goods.

If the consumer withdraws from the contract, Taxi31300 must repay the consumer all payments that Taxi31300 has received from the consumer immediately and at the latest within 14 days of receipt of the declaration of withdrawal, with — if necessary — Section 16 FAGG applying mutatis mutandis. For this repayment, Taxi31300 will use the same means of payment that the consumer used for the original transaction, unless something else has been expressly agreed with the consumer. However, Taxi31300 can refuse repayment to the consumer until Taxi31300 either receives the goods back from the consumer or the consumer has provided it with proof that the goods have been returned.

  1. Prohibition of offsetting

The customer can only offset our claims against counterclaims established by the court or expressly recognized by us in writing in individual cases.

Consumers can also offset their counterclaims if these are legally related to their liability to us and if we are unable to pay.

  1. liability

Our information about waiting times or arrival dates is non-binding. We are not liable for any delays. Claims by the contractual partner for damages due to late collection of the contractual partner by the taxi company or late arrival at the destination are excluded from us. The customer will always resolve complaints or other disagreements arising from the legal relationship between him and the contractual partner of Taxi 31300 directly with the contractual partner of Taxi 31300. Taxi 31300 is excluded from liability in this context.

Our liability extends to the forwarding of orders and other declarations of intent between the customer and the arranged taxi company and vice versa, if applicable. Any liability of Taxi31300 towards persons other than the customer is expressly excluded. In each case, Taxi31300 is not liable for indirect damage, lost profit, interest losses, missed savings, sequential and financial losses, damages arising from third-party claims and for the loss of data and programs or their recovery.

The following applies to entrepreneurs: In any case, we are only liable for intentional or grossly negligent conduct on our part, in which context the reversal of the burden of proof within the meaning of Section 1298 sentence 2 ABGB is waived. Claims for damages, in particular claims made instead of warranty claims, expire within six months of becoming aware of the damage and the person causing the damage.

The following applies to consumers: Liability for slight negligence is excluded, with the exception of personal injury.

The customer is responsible for the proper storage and use of taxi cards, customer cards, secret words and/or vouchers as defined in point 3 of these terms and conditions and must protect them from unauthorized access and misuse. Taxi31300 is not liable and does not compensate for lost taxi cards, customer cards, secret words and/or vouchers. Taxi31300 is also not liable if the taxi cards, customer cards, secret words and/or vouchers are used by an unauthorized person for whatever reason, and not until the customer has duly blocked the taxi cards, customer cards, and/or vouchers and/or the secret word within the meaning of point 4 of these terms and conditions and Taxi31300 has expressly confirmed this suspension to the customer. In the event of express confirmation of the suspension by Taxi31300, the liability limitations within the meaning of these terms and conditions apply (Taxi31300 is only liable in case of intent or (gross) gross negligence) and the liability of Taxi31300 is also limited in any case to the amount of the respective value of the taxi cards, customer cards, secret words and/or vouchers at the time the suspension is confirmed by Taxi31300.

  1. Exemption from the fulfilment of contracts

Force majeure and its consequences release us from the obligation to arrange transport services. The customer also expressly agrees that force majeure and its consequences also exempt taxi companies from the obligation to transport. Force majeure also expressly includes traffic jams.

  1. Data protection notices

The customer or passenger data provided in the course of an order, in particular name, address, email, telephone number, order information such as pick-up address, destination address, flight number and departure location when ordering an airport taxi, as well as any special requests, are processed electronically by us for the purpose of arranging the transport services and forwarded to the required extent to the arranged taxi company that carries out the transport service. The taxi companies are independent controllers and must comply with all relevant data protection obligations.

As part of our SMS service, after ordering a taxi, you will receive an SMS with more detailed information about the trip (in particular when the taxi arrives). For this purpose, when ordering via mobile phone, the telephone number sent is automatically recorded and processed. When ordering via the Internet, the telephone number provided by the customer is processed. If you do not want this service, you can contact us at any time (see point 12 Contact) and arrange for a free suspension.

The legal basis for processing by Taxi 31300 is the fulfilment of the contract concluded with you to arrange a transport service (Article 6 (1) (b) GDPR) or, if you are not a party to the contract yourself, the legitimate interests of Taxi 31300 and the contracting party that commissioned the transport service (Article 6 (1) (f) GDPR).

We use various service providers as contract processors to provide brokerage services:

  1. a) When ordering by telephone, the customer or passenger data is collected in our call center. For this purpose, we use Taxi Pay GmbH, Berlin, as contract processor. Other (sub) contract processors include TZB Callcenter GmbH, Taxi Funk Berlin TZB GmbH, CabTech GmbH, each based in Berlin, and Mobil Garanti Otomobil hizmetleri A.S., Turkey. The data collected is stored exclusively within the EU.
  2. b) To process cashless payments, the customer's payment data is forwarded to the payment service provider commissioned by us and processed by the latter for the stated purpose.
  3. c) In addition, we use various IT service providers who can gain access to personal data as part of the provision of maintenance services.

In any case, we require our contract processors to take appropriate data security measures and ensure that your data is protected.

The collected data is stored by Taxi 31300 within the legal retention periods (in particular under UGB and BAO) and also for as long as necessary to assert, exercise or defend legal claims (in particular during pending or impending legal disputes).

  1. Ineffective application of individual provisions

If these terms and conditions contain (contain) one (or more) gap (s) or one (or more) provision (s) is (are) or will (become) invalid in whole or in part, the remaining terms and conditions remain effective as will the conclusion of the contract. Instead of the missing or ineffective provision (s), a provision (s) (corresponding) closest to the economic purpose of the missing or ineffective provision (s) shall apply.

  1. Applicable Law, Place of Fulfilment and Jurisdiction

It is agreed that the laws of the Republic of Austria will apply to the exclusion of its referral standards. The application of the UNCITRAL Sales Convention 1980 is excluded. The place of fulfilment for delivery and payment is Vienna.

The competent court for Vienna Innere Stadt is exclusively responsible for all disputes arising from the contractual relationship.

Supplementary terms and conditions for in-app payment

APP Payment Terms and Conditions (AGB) and Privacy Statement

§ 1 General; subject

The following terms and conditions regulate the cashless payment of taxi rides (hereinafter referred to as “APP Payment”) as part of the use of the taxi app and supplement the passenger terms and conditions (general terms and conditions).
APP Payment is payment transactions in which at least the person subject to payment uses mobile electronic techniques to initiate, authorize or realize the payment, for example using mobile devices such as mobile phones or tablet computers. With APP Payment, passengers can pay the transport fee cashlessly via an app.

fms Systems GmbH and Austrosoft® Weiss Datenverarbeitung provide the technical infrastructure for APP Payment. Austrosoft® acts as a contract data processor in accordance with the GDPR. APP Payment offers various payment methods, such as credit cards, taxi customer cards, PayPal, etc. These payment methods are processed between the intermediary taxi center and certified payment service provider. Payment service providers may be: Braintree/PayPal (Europe) S.a.r.l et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter
“PayPal”) or First Data GmbH, Marienbader Platz 1, 61348 Band Homburg v.d. Höhe, Germany (hereinafter “FiServ”)

The payment process itself is always agreed between the customer and the intermediary taxi center. A list of taxi centers that can support APP Payment is included in Appendix 1 to these terms and conditions. Please note that the payment methods actually available depend on the respective taxi center and there is no guarantee that all technically possible payment methods will actually be accepted.
This contract is concluded between the passenger (hereinafter referred to as “customer”) and the intermediary taxi center (hereinafter referred to as “taxi center”). The terms and conditions for APP Payment govern the mentioned contractual relationship. The brokerage contract with the taxi center, including the payment process, and the contract of carriage between the taxi company and the customer remain unaffected.

§ 2 Rights and obligations of the contracting parties a Services and obligations of the taxi center:

aa. The taxi center provides the customer with the technical infrastructure for the cashless payment process “APP Payment” within the taxi app.
bb. With APP Payment, customers can store payment methods, such as PayPal, credit cards or taxi customer cards. When registering new means of payment, the taxi center reserves the right to verify the validity of the means of payment by authorizing a cent. However, the authorization does not trigger a payment process. The customer can use APP Payment to pay the transportation fee due to the taxi operator. The payment process itself is always agreed between the customer and the respective taxi center.
cc. There is no guarantee that the “APP Payment” payment process will be available without interruption. A guarantee for available taxis that participate in APP Payment can also not be provided.
dd. The taxi center strives to ensure that the system is highly reliable.
b. Duties, services and rights of the customer
aa. The customer is obliged to provide correct and truthful data to the taxi center. Use must not interfere with or overload the taxi center systems.
bb. The customer himself must ensure data security (user name, password, PIN). In particular, no communication or transfer of sensitive data to third parties may take place.
cc. In the event of loss of relevant data, the taxi center is immediately available via the email address

dd. The use of a functioning Internet connection is part of the customer's obligations.
ee. The user must ensure that the means of payment used is sufficient. As part of the registration process, the customer is required to provide a valid email address to which only the customer has access and to which his account is linked. When registering their account, the customer stores the existing means of payment, such as credit cards, PayPal, etc. It is not guaranteed that every means of payment can be used for payment in every city where the taxi app is used. The user agrees that when registering new means of payment, the validity of the means of payment may be checked by authorizing a cent amount. However, the authorization does not trigger a payment process.
ff. The customer is entitled to delete means of payment from his payment account at any time, to add further means of payment within the scope of the options offered or to delete the entire account.
gg. During the APP payment process, the taxi driver is never informed of the customer's means of payment behind it. Based on the contract between the payment method issuer and the customer, all mentioned means of payment may incur additional fees, which are charged outside of APP Payment.
hh. The customer is required to provide a valid email address and mobile phone number when registering. The email must be confirmed via email verification.
ii. Using the APP Payment function requires ordering transportation via APP or via central office.

§ 3 Special features of APP Payment

a. APP Payment is an alternative to cash payments in taxis, which are also possible. Accordingly, the customer does not have to use the Payment APP; it is just another payment option for the customer.
b. The prerequisite for using APP Payment is that the taxi operator is connected to the system. There is a clear label to orient the customer.
c. As part of the registration process for APP Payment, the customer selects the registered means of payment (e.g. credit card or PayPal).
d. The customer can choose a personal identification number (PIN) to secure APP payments and receipts.
e. If the customer uses PayPal, he pays the amount without disclosing the bank or credit card details to the taxi center. The registration of this data and the electronic withdrawal process takes place directly between the customer and PayPal. The customer may incur PayPal fees. The customer needs a PayPal account to use the PayPal payment option.
f. If the customer uses AmazonPay, he pays the amount without disclosing the bank or credit card details to Traxi headquarters. The registration of this data and the electronic withdrawal process takes place directly between the customer and AmazonPay. Customers may incur AmazonPay fees. The customer needs an AmazonPay account to use the AmazonPay payment option.
g. The customer is obliged to protect the account from unauthorised access and may not pass on the access data, in particular the PIN, to third parties.
h. In the event of loss or theft, an immediate blocking report must be sent to office@taxi31300.at.

§ 4 Costs and prices

a. In principle, the customer does not incur any costs for using APP Payments. There are two exceptions to this:
aa. There may be a tariff-related surcharge for cashless payments. The type and amount depend on the local taxi rates applicable at the time.
bb. The customer bears the costs of Internet access.
b. The amount for the service is reported to the taxi center by the taxi driver or taxi company. The customer can add a tip as an option.
c. The taxi center responsible for arranging transportation may collect these amounts on behalf of its operators.

§ 5 Conclusion of contract and withdrawal from the contract
The contract between the taxi center and the customer is concluded by completing the registration and accepting these terms and conditions.
The contract ends when the APP Payment account is deleted. The contract can be terminated or terminated at any time by both parties and is effective immediately. However, any obligations established up to this point in time remain in place; in particular, the passenger/customer is obliged to pay outstanding invoices, even if the account has been deleted in the meantime.

§ 6 Liability

a. Liability is generally in accordance with legal regulations.
However, the taxi center is not liable for slight negligence. However, this does not apply if the taxi center breaches particularly important obligations, so-called “cardinal obligations” due to slight negligence. In this case, the taxi center is obliged to compensate for the typically foreseeable damage.
b. If a chargeback occurs as a result of conduct for which the customer is responsible, the customer must bear the chargeback costs.
c. The taxi center assumes no liability for the correct processing of cashless payments, in particular for credit card, PayPal or AmazonPay payments. In the event of problems and disruptions in contract processing, in particular incorrect bookings, the user must contact his contractual partner, the payment service provider.
In the event of a culpable breach of due diligence obligations by the user, see in particular § 2 b of the General Terms and Conditions, the user is obliged to compensate the taxi center for the resulting damage.
The taxi center is released from liability by the customer in the event of a breach of law by the customer, in particular in the event of a breach of the obligations set out in § 2 b

§ 7 Data protection

The taxi center collects, processes and uses operational and personal data within the framework of legal regulations (name, address, telephone number, email address) to fulfill a contract to which the customer is a party and to carry out pre-contractual measures (Art 6 (1) lit b) GDPR). Within this framework, the customer also expressly agrees to the collection, processing and use of his personal data by the taxi center and its technical service providers and partners in accordance with Appendix 1.
The customer agrees to the use of GPS data when using APP Payment to bill the trip (start and destination address, time of departure and arrival) and to automatically transfer this trip data to the automatically generated receipt or invoice. This data is deleted in accordance with legal requirements.
The data required for the receipts is deleted when the customer removes their receipts from the app.

§ 8 Valid Law and Place of Jurisdiction

Insofar as there are no mandatory legal regulations to the contrary, Austrian law and the exclusive place of jurisdiction is Vienna.

§9 Salvatory clause

Should provisions of the contract or these terms and conditions or a provision included in the future be invalid or unenforceable in whole or in part or lose their legal validity or enforceability at a later stage, this shall not affect the validity of the remaining provisions. The same applies if it should become apparent that there is a regulatory gap. The parties agree that the invalid or unenforceable provisions or to fill the gap should be replaced by an appropriate provision which, as far as legally possible, comes closest to what they wanted or would have wanted according to the meaning and purpose of the contract if the invalidity, impracticability or omission had been known. This also applies if the invalidity of a provision is based, for example, on a measure of performance or time (deadline or deadline) prescribed in the contract; a legally permissible measure of performance or time (deadline or deadline) that comes as close as possible to the intended purpose should then be considered agreed.
